The latest HSMP judicial review was in effect starting April 8 2008 and the latest review was forwarded by the HSMP Forum Ltd. You will be part of the review if you are part of the Highly Skilled Programme with arrangements that were in place when the original program was put on hold on November 7, 2006. There are numerous groups that are covered by this review and the inclusion of one migrant into one group will depend on his unique circumstances.
The first group is for those migrants who hold the HSMP leave who happens to have applied for his extension of stay or will file for the extension in the future. The requirements for the possible extension are the same to those in place before November 7, 2006. The second group of migrants under the new review is the ones who applied for the extension but was refused and these migrants have filed their appeal or have an on-going appeal. The migrant will be part of this group if he was refused an extension of stay after December 5, 2006.
The third group is the one that hosts migrants who were refused the extension of stay and then switched to different immigration category. The migrant who is under this situation can ask for the review of the original refusal using the rules and the arrangements that were in used before November 7, 2006. The last group includes those migrants that did not apply for extension and also switched immigration category. If the migrant is part of this group then he can apply for the Tier 1 visa even though the migrant made the switch into a different immigration category.
